Terms of Service

Last updated:

These terms apply to businesses that use wajha (wajha.cc). By signing in or using the service, you agree to them. Wajha is run by Ahmad Nasser, an individual in Lebanon.

The service

Wajha gives each business a menu website at its own address, such as name.wajha.cc, or at its own domain. Each site has a bilingual Arabic and English menu, a cart that sends the order to the business as a WhatsApp message, and an admin area where the business edits its menu, photos, prices, hours and settings. Some businesses also take optional add-ons, such as an Instagram feed.

Who may use Wajha

Wajha is offered to businesses. You may use it only if you are authorised to act for the business.

Your content

You are responsible for everything published on your site. You must:

  • own the text and photos you publish, or have the rights to use them;
  • keep prices, allergen information and opening hours accurate;
  • not publish content that is unlawful or that infringes anyone else’s rights.

Your account

Keep your password safe. You are responsible for activity under your account and for the staff you give access to. Tell us promptly if you think someone else is using your account.

Orders and customers

Wajha is not a party to orders between a visitor and a business. The business is responsible for accepting, preparing and delivering its orders, and for any arrangement it makes with its customers. Wajha takes no commission on orders and does not handle payments between visitors and the business.

Fees and payment

Paid plans are billed monthly or yearly, at the price agreed with the business. Custom designs and extra add-ons are agreed separately.

Payment is made by hand, by Whish, OMT, cash or bank transfer, and we record each payment by hand.

We send email reminders 3 days before the due date, on the due date, and 7 days after it. Yearly plans also get an earlier notice.

If a payment is more than 30 days late, the admin area becomes read-only, so you cannot edit your menu, until the account is settled. Your public menu is not changed or taken down automatically.

We may disable a site for non-payment, but only after we have contacted the owner.

Fees already paid for a period are not refunded unless we agree otherwise.

Availability and changes to the service

We aim to keep Wajha highly available, but we do not guarantee uninterrupted service. Features may change over time.

Stopping

You can stop using Wajha at any time by telling us. You can ask us for a copy of your menu data. Fees already paid are handled as described under fees and payment. For what happens to your data, see the Privacy Policy.

Removing content and suspending sites

We may remove content, or suspend a site, that is unlawful or abusive. We may also disable a site for non-payment, as set out above.

Liability

To the extent the law allows, Wajha is provided “as is”. We are not liable for indirect or consequential loss, or for third-party services such as WhatsApp, Instagram and Google.

To the extent the law allows, Wajha’s total liability is limited to the fees the business paid for the last 3 months.

Governing law and disputes

These terms are governed by the laws of Lebanon. If a dispute arises, we will first try to resolve it through good-faith discussion. If that does not resolve it, the competent courts of Beirut will decide it.

Changes to these terms

We may update these terms, and we will tell you about changes by email. If you keep using Wajha after the notice, you accept the changes.
